Patna High Court

Pujan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

The petitioner, Pujan Kumar, was arrested in connection with the recovery of 103 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act, 2022 (Isuapur P.S. Case No. 87 of 2026). He has been in custody since 13 March 2026 and claims to have no prior criminal record, asserting that he has been falsely implicated. The petitioner’s counsel argued that the circumstances, including the lack of antecedents and the nature of the alleged offence, warranted the grant of bail. The High Court, after considering the quantum of the recovery and the petitioner’s personal circumstances, allowed the bail application. The court ordered the petitioner to be released on a bail bond of Rs. 10,000 with two sureties, while clarifying that the order is limited to bail and does not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2022 considering the quantum of illicit liquor recovered.
  • Whether the petitioner’s lack of criminal antecedents and claim of false implication justify the grant of bail.
