Holding

The court allowed the petition for anticipatory bail, subject to conditions, under Section 438(2) CrPC read with Section 482(2) B.N.S.

Summary

Petitioner Prince Kumar sought anticipatory bail fearing arrest in a case registered under Sections 137(2), 351(2) and 3(5) of the B.N.S., alleging that he lured a minor girl for marriage. The prosecution alleged that the petitioner, together with another person, induced the informant's minor daughter to leave her home for the purpose of marriage. The petitioner contended that the relationship was consensual, the girl was about 17 years and 8 months old, and there was no evidence she was a minor; he also asserted a clean criminal record. The court examined the submissions and, applying Section 438(2) of the CrPC and Section 482(2) of the B.N.S., granted anticipatory bail subject to strict conditions including surety, personal appearance, and verification of antecedents. The order emphasized that the bail conditions are not to be delayed for verification and that the observations made are not binding during trial.

Issues considered

  • Whether anticipatory bail should be granted in a case involving alleged abduction of a minor for marriage under Sections 137(2), 351(2) and 3(5) of the B.N.S.
  • Whether the age of the alleged victim and the claim of consent affect the grant of anticipatory bail.
  • Whether Section 438(2) CrPC and Section 482(2) B.N.S. empower the court to impose conditions on anticipatory bail.
