BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to bond and surety conditions.

Summary

Vikash Kumar, the registered owner of a motorcycle from which 19 litres of liquor was seized, sought anticipatory bail after an FIR under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022 implicated a third party, Dablu Kumar, for using his vehicle. The petitioner argued that there was no direct allegation against him, no possession of liquor, and he had no criminal antecedent. The State opposed the bail, relying on the FIR allegations. The Court examined whether the petitioner’s mere ownership of the vehicle sufficed for arrest and concluded that anticipatory bail was appropriate. Accordingly, the Court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail can be granted when the accused is only the registered owner of a vehicle from which contraband was seized, without direct involvement in the alleged offence.
