Patna High Court

Md. AkinversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Bail was denied to the petitioner.

Summary

The petitioner, Md. Akin, was arrested in connection with a robbery (Section 392 IPC) involving a loot of Rs. 2,90,000. He claims he has been falsely implicated, has no prior criminal record, and has been in custody since 21‑12‑2025, offering to cooperate with the investigation. The prosecution opposes bail, citing forensic evidence (SDR, CDR) and alleged communication with co‑accused. The court considered these submissions and, despite another accused being granted bail by a coordinate bench, found the circumstances sufficient to deny bail. Consequently, the bail application was dismissed.

Issues considered

  • Whether bail should be granted to the accused under Section 392 IPC given the alleged involvement and evidentiary material presented by the prosecution.

2 20-04-2026 Heard learned counsel for the petitioner and learned

Additional Public Prosecutor for the State.

                                2. The petitioner seeks bail in connection with

Kursakanta (Sonamani Godam) P.S. Case No. 299/2023

registered for the offences punishable under Section 392 of

                   I.P.C.

                                3. As per the prosecution case, unknown criminals

committed loot of Rs. 2,90,000/- from the informant and the

name of the petitioner has come during investigation.

                                4. Learned counsel for the petitioner submits that

petitioner has falsely been implicated in the case. Learned

counsel further submits that he has no criminal antecedent and

he is in custody since 21.12.2025. The petitioner undertakes to

                                     5. Learned APP for the State has opposed the prayer

for regular bail of the petitioner and submitted that on the basis

of S.D.R., C.D.R. and tower location, the petitioner was found

                        talking to other accused persons.

                                     6. Considering the aforesaid facts, I am not inclined to

grant bail to the petitioner despite the fact that the other accused

person has been granted bail by a Co-ordinate Bench of this

                        Court.

                                     7. Accordingly, this application stands dismissed.
