Patna High Court

Radha DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to a bail bond and conditions under Section 438(2) Cr.P.C. and Section 482(2) BNSS, 2023.

Summary

The petitioner, Radha Devi, sought anticipatory bail after an FIR alleged that 9.75 litres of liquor were recovered from her residence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. She contended that the seizure list lacked her family’s signature, there was no independent witness, and the liquor was found in a joint family house, not in her personal possession, and she has no criminal record. The State opposed the bail on the basis of the FIR allegations. The Court, after considering the facts, granted anticipatory bail, directing that she be released on a bail bond of Rs. 10,000 with two sureties, within four weeks of the order, subject to conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order ensures her release if arrested or if she surrenders, pending trial.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 Cr.P.C. and Section 482 BNSS in view of the alleged offence under the Bihar Prohibition and Excise Act, 2016.
  • Whether the seizure of liquor from a joint family house without the petitioner’s signature or an independent witness justifies denial of anticipatory bail.
