Jitendra TantiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner with specified conditions.

Summary

The petitioner, Jitendra Tanti, was arrested in connection with the seizure of 267.75 litres of illicit English wine from a vehicle he was traveling in, alleged under section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022. He applied for regular bail, claiming innocence, having only one prior criminal antecedent, and having been in custody since 16‑02‑2026. The petitioner offered to donate Rs.25,000 to a charitable organization without admitting guilt. The State opposed the bail. The High Court, after considering the facts and submissions, granted bail on a bond of Rs.10,000 with two sureties, conditioned on the donation of Rs.25,000 to Ramakrishna Math, production of the receipt, and attendance at Dobhi Police Station on two Sundays each month, with non‑compliance leading to cancellation of bail.

Issues considered

  • Whether regular bail should be granted to a person accused under section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022.
  • Whether the conditions imposed by the court, including a charitable donation and periodic police station attendance, are permissible under bail law.
