BAIL GRANTED

Holding

Anticipatory bail is granted to the petitioner with a bond of Rs 10,000 and two sureties, subject to the conditions prescribed under Section 438(2) Cr.P.C. and Section 482(2) BNSS.

Summary

The petitioner, Parwez Alam, a resident of Gayaji, is the registered owner of a tempo from which 145 litres of country‑made liquor was seized, alleged to be a violation of Section 30(a) of the Bihar Prohibition and Excise Act. He applied for anticipatory bail, contending that the tempo was being used as a public carrier, the driver fled, and there is no independent witness to the seizure; he also has no prior criminal record. The State opposed the bail on the basis of the FIR allegations. The Court, after considering the facts, granted anticipatory bail subject to a bond of Rs 10,000 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order directs the petitioner to surrender within four weeks if arrested. The bail is conditioned on compliance with the stipulated terms.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS in view of the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Act.
