Patna High Court

Ritesh Kumar @ Ritesh Kumar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioners are entitled to regular bail.

Summary

The petitioners, Ritesh Kumar and Amit Yadav, were arrested in connection with a land dispute that resulted in injury to a victim, and were charged under multiple sections of the B.N.S. and Section 27 of the Arms Act. They applied for regular bail, claiming innocence and asserting that the first petitioner has a clean antecedent while the second has only one prior criminal record. The State, represented by the Additional Public Prosecutor, opposed the bail. The court, after considering the facts, the petitioners' cooperation, and their relatively clean records, decided to grant bail. Each petitioner was ordered to furnish a bail bond of Rs. 10,000 with two sureties of the same amount, subject to the satisfaction of the concerned court. The application for regular bail was therefore allowed.

Issues considered

  • Whether the petitioners are entitled to regular bail despite the serious charges under the B.N.S. and Arms Act?
  • Whether the petitioners' antecedents and willingness to cooperate justify the grant of bail?

  • Arms Act — s. 27
