Patna High Court

Sagar PanditversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Regular bail was granted because charge‑framing had not occurred and the petitioner possessed a clean antecedent, making bail appropriate despite the serious nature of the allegations.

Summary

The petitioner, Sagar Pandit, was charged in a dowry‑death case under IPC sections 304B and 34 and Sections 3 and 4 of the Dowry Prohibition Act. He had been in custody since 3 March 2025 and his earlier bail application was rejected. The petitioner’s counsel argued that he was falsely implicated, had no prior criminal record, and that charge‑framing had not yet occurred, warranting regular bail. The State opposed the bail, citing the seriousness of the alleged offences. The Court, after considering the circumstances, allowed the regular bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether regular bail can be granted in a case of alleged dowry death under IPC 304B, 34 and Dowry Prohibition Act before charge‑framing.
  • Whether the petitioner’s clean antecedents and the absence of charge‑framing justify bail despite the gravity of the alleged offences.
