Patna High Court

Rameshwar PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner with conditions.

Summary

The petitioner, Rameshwar Paswan, was arrested on 17 September 2025 and charged under multiple sections of the Indian Penal Code—including offences relating to unlawful assembly and rioting—and Section 27 of the Arms Act. He applied for bail, claiming innocence and that the allegations against him were vague and omnibus. The High Court noted the length of his pre‑trial detention and the lack of specific evidence, and consequently granted bail. The court ordered a bail bond of Rs 10,000 with two sureties and imposed a condition that the petitioner report to the police station every Sunday of each month. The order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether bail should be granted to the petitioner given the nature of the charges and the period of pre‑trial custody
  • Whether the allegations against the petitioner are sufficiently specific to deny bail

                                   2. The petitioner seeks bail in connection with

Dinara P.S. Case No. 154 of 2025 / Sessions Trial No. 91 of

2026 registered for the offence under Sections 191(2), 191(3),

                    allegation against the petitioner.

                                    6. Considering the period of custody of the

petitioner and the fact that the allegations are general and

                    omnibus, this application is allowed.

                                     7. Let the petitioner, above named, be released on

bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)

with two sureties of the like amount each to the satisfaction of

the learned concerned Court below in connection with Dinara

                    P.S. Case No. 154 of 2025 / Sessions Trial No. 91 of 2026.

                                    8. As a condition of this order, the petitioner after

being released on bail is directed to mark his attendance at

Dinara Police Station on every Sunday of each month. Any

default in appearance at the police station will result in

cancellation of bail bonds of the petitioner.

                                    9. It is, however, clarified that the observations

made herein are limited to the adjudication of the present bail

application and shall not prejudice the case of the petitioner at

any subsequent stage of the trial and this Court has not

expressed any opinion on the merits of the case.
