Patna High Court

Dharmraj KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court denied bail, holding that the magnitude of the narcotic seizure warranted denial of regular bail.

Summary

The petitioner, Dharmraj Kumar, was arrested in connection with FIR No. 65 of 2025 under Sections 20(b)(ii)(C), 23(c), 25 and 29 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act for the alleged recovery of 57.880 kg of ganja from a Bolero vehicle. He applied for regular bail, claiming innocence despite having one prior criminal antecedent and having been in custody since 18‑05‑2025. The State opposed the bail on the ground of the large quantity of narcotics involved. The Patna High Court, after hearing counsel, dismissed the bail application, noting the seriousness of the offence due to the huge quantity seized. The court directed the trial court to expedite the trial and clarified that its observations were prima facie and not a determination on the merits of the case.
