Patna High Court

Kailoo Yadav @ Kailu Yadav @ Ramesh YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to specified conditions.

Summary

Kailoo Yadav was arrested in connection with a case registered under multiple sections of the Bharatiya Nyaya Sanhita, 2023, including offences of assault and other serious crimes. He applied for regular bail, claiming innocence and citing only one prior criminal case from 2006. The State opposed the bail, but the court noted that co‑accused in a similar matter had been granted anticipatory bail by a coordinate bench. Considering the nature of the allegations, the length of custody, and the precedent, the court allowed the regular bail application subject to a cash bond and two sureties, with conditions regarding verification of antecedents and cooperation in trial. The order expressly limited its observations to the bail application and stated they should not affect the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious charges under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the prior criminal antecedent and the grant of anticipatory bail to co‑accused influence the bail decision.
  • Whether the conditions imposed by the court are appropriate for the grant of bail.

by a co-ordinate Bench of this Court in Cr. Misc. No. 65342 of

                       5. Learned A.P.P. for the State has vehemently

          opposed the prayer for bail.
