Patna High Court

Kameshwar Das @ Kamdeo DasversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court held that regular bail could not be granted to the petitioner.

Summary

The petitioner, Kameshwar Das, was charged in a 2005 FIR for offences under Sections 457 and 380 of the Indian Penal Code, involving dacoity and looting of ornaments. He remained an absconder for 21 years and was taken into custody on 21 January 2026. He applied for regular bail before the Patna High Court. The Court examined the seriousness of the offences, the long period of evasion, and the fact that charges had not yet been framed. Considering these circumstances, the Court declined to grant regular bail, allowing the petitioner only to approach the lower court after charges are framed. The order was made clear to be prima facie and not to affect the merits of the trial.
