Patna High Court

Sonu Kumar @ Sona Sahni @ Sonu SahniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a cash bond, sureties and specific conditions.

Summary

The petitioner, Sonu Kumar, was arrested on 28 January 2026 in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 for alleged possession of 4 litres of country‑made liquor seized from his house. The petitioner’s counsel argued that the liquor was not found in his conscious possession and that the seizure list, prepared solely by police personnel, violated Sections 103 and 105 of the Bihar Non‑Statutory Search and Seizure (BNSS) Act, 2023. The prosecution opposed bail, contending that the recovery was made from the petitioner’s premises, that he was apprehended at the scene, and that he has a prior criminal antecedent, though he is already on bail in another matter. The court examined the material and, notwithstanding the alleged procedural lapses and the antecedent, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of his criminal record. The order directed that the bail bond not be delayed for verification purposes and stipulated cancellation upon breach of the conditions.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 considering the alleged procedural irregularities in seizure under the BNSS Act, 2023.
  • Whether the petitioner’s prior criminal antecedent warrants denial of bail.
