Patna High Court

Subhash RatnaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to a bail bond of Rs.10,000 and two sureties, under Section 482(2) of the B.N.S.S. Act.

Summary

The petitioner, Subhash Ratna, was implicated in a land fraud case (P.S. Case No. 1227 of 2023) involving alleged false entries in land records and multiple IPC offences (419, 420, 467, 468, 471, 427/34). He contended that he was a bona‑fide purchaser of the land from the rightful owners and had no criminal antecedent, while the FIR also named the Sub‑Registrar and other vendors. The State opposed his request for anticipatory bail. The Court examined the nature of the dispute, noted that bail had already been granted to several vendors, and considered the petitioner’s claim of innocence and lack of prior convictions. Consequently, the Court ordered that the petitioner be released on anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the B.N.S.S. Act. The order was made by Justice Khatim Reza.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in the land fraud case under Sections 419, 420, 467, 468, 471 and 427/34 IPC.
  • Whether the petitioner’s claim of being a bona‑fide purchaser and having no criminal antecedent warrants bail.
