ANKESH RANJANversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The High Court granted anticipatory bail to the petitioner subject to a bail bond and sureties, invoking its inherent powers under Section 482(2) of the Bharatiya Nyaya Sanhita.

Summary

Ankesh Ranjan, a director of Nestiva Medicare Private Limited, sought anticipatory bail after the police registered a case (Gardanibagh P.S. Case No. 623 of 2025) alleging offences under multiple sections of the Bharatiya Nyaya Sanhita, 2023, including fraud, criminal conspiracy and illegal construction. The prosecution alleged that Ranjan and a co‑director unlawfully seized the informant's property by entering into a lease agreement and later attempting to capture it. Ranjan contended that he was a lawful tenant under a registered lease deed, had invested in constructing a hospital, and that the dispute was purely civil, supported by CCTV footage showing no illegal activity. He also highlighted that the informant had previously filed several criminal complaints against him and others. The court, after considering the submissions, ordered that Ranjan be released on anticipatory bail upon furnishing a bail bond of Rs 10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nyaya Sanhita.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in view of the charges under the Bharatiya Nyaya Sanhita, 2023.
  • Whether the alleged acts constitute a criminal offence or are merely a civil lease dispute.
