The Court extended the surrender period by an additional four weeks.

Summary

The petitioners, Shiv Shankar Singh, Vicky Kumar and Pravesh Kumar, were granted anticipatory bail by the Patna High Court in Criminal Appeal (SJ) No.4032 of 2024, with a direction to surrender before the lower court within four weeks to furnish bail bonds. They filed an application seeking modification of that order to extend the surrender period. The State of Bihar opposed the extension, arguing that the original time limit was sufficient. The Court considered the submissions of both parties and the need to balance the petitioners' right to bail with procedural requirements. It held that extending the surrender period by an additional four weeks was appropriate, and accordingly modified the order. The application for modification was allowed.

Issues considered

  • Whether the period granted to the petitioners for surrendering before the lower court to furnish bail bonds can be extended.
