The Court granted bail to the petitioner subject to a bond and specified conditions.
Summary
Aman Khan was arrested in connection with FIR dated 19.07.2024 alleging assault and firing on the husband of an informant during a religious procession, charged under several sections of the Bharatiya Nyay Sanhita, 2023 and section 27 of the Arms Act. He applied for bail, claiming innocence and that the incident was a spur‑of‑the‑moment act without intent to kill, and pointed out that co‑accused had already been granted anticipatory bail. The prosecution opposed bail, highlighting a specific allegation of firing against the petitioner and his eight prior criminal convictions. The Court considered the facts, the petitioner’s custody since 03.12.2025, and the conditions precedent for bail. It ordered that the petitioner be released on bail upon furnishing a Rs 10,000 bond with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of antecedents. The bail order was conditioned on cancellation if the petitioner fails to appear or conceals his criminal record.
Issues considered
- Whether bail should be granted to the petitioner despite serious charges under the Bharatiya Nyay Sanhita and the Arms Act
- Whether the petitioner’s criminal antecedents and specific allegation of firing preclude bail
- Whether the conditions imposed are sufficient to safeguard the trial process
