Patna High Court

Nitesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner with specified conditions.

Summary

The petitioner, Nitesh Kumar, sought regular bail in a case registered under Sections 25(1‑B)(i), 25(ix), 26 and 35 of the Arms Act, alleging that he was falsely implicated based solely on the co‑accused's statement. The FIR alleged that a video showed the co‑accused brandishing a pistol, and a country‑made pistol and live cartridge were recovered from the co‑accused's house, not the petitioner's. The petitioner argued that no incriminating article was found in his possession or residence and that he had been in custody since 27‑Oct‑2025. The State opposed the bail. The Court, after considering the facts, granted bail on a cash bond of Rs.10,000 with two sureties, subject to conditions including cooperation with trial, regular reporting to the police, and non‑tampering with evidence or witnesses. The application was allowed.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences under the Arms Act.
  • Whether the allegations against the petitioner, based solely on the co‑accused's statement, justify denial of bail.
