Holding

The court held that the criminal appeal dismissed for default should be restored to its original file.

Summary

Pandav Yadav filed an application seeking restoration of Criminal Appeal (SJ) No.2867 of 2024, which had been dismissed for default on 15 July 2025. The petitioner argued that the dismissal was erroneous and requested that the appeal be reinstated to its original file. The learned Additional Public Prosecutor opposed the restoration. Justice Rajesh Kumar Verma examined the petition and found merit in the petitioner’s reasons for restoration. Consequently, the court ordered that the appeal be restored to its original file and directed that the requisites filed on 16 July 2025 may be used for notice purposes. The restoration petition was thereafter disposed.
