The court granted bail to the petitioner.

Summary

The petitioner, Md. Eklakh Ahmad, was arrested in connection with a case registered under Sections 351(2), 352, 109 and 3(5) of the Bihar Non‑Statutory (BNS) provisions and Section 27 of the Arms Act, alleged to have fired at an informant’s house. The prosecution argued that the petitioner and others discharged firearms, while the defence contended that the allegations were vague, no cartridge was recovered, no injury occurred, the petitioner had no prior criminal record and had been in judicial custody since 19‑02‑2026. The petitioner applied for bail, offering a bond of Rs.10,000 with two sureties. The State opposed the bail application. After hearing both sides, the court found the lack of concrete evidence and the petitioner’s clean antecedents sufficient to justify bail. Consequently, the court ordered the petitioner’s release on bail upon furnishing the stipulated bond and sureties.

Issues considered

  • Whether bail should be granted to the petitioner charged under Sections 351(2), 352, 109, 3(5) of the BNS and Section 27 of the Arms Act given the facts of the case.
