The court granted anticipatory bail to the petitioner, subject to bond and conditions, finding that the allegations did not justify denial of bail.
Summary
Navneet Kumar, the owner of a pick‑up van, was implicated in a case involving the seizure of 1,899 litres of illicit foreign liquor and charged under Sections 420, 467 and 468 of the IPC and Sections 30(a) and 41 of the Bihar Prohibition and Excise Act. He applied for anticipatory bail, arguing that no liquor was found in his conscious possession and that the charge was based solely on his ownership of the vehicle, with procedural lapses in the seizure under Section 100 CrPC/Section 103 of the Bhartiya Nagarik Suraksha Sanhita. The State opposed bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act and citing the petitioner’s prior criminal record. Relying on the precedent set in Ram Vinay Yadav v. State of Bihar, the court granted anticipatory bail subject to a Rs 10,000 bond, two sureties, and strict conditions regarding cooperation, non‑tampering with evidence, and verification of criminal antecedents. The order directs the petitioner to surrender within thirty days if arrested and outlines consequences for breach of conditions.
Issues considered
- Whether anticipatory bail can be granted in a case involving offences under the IPC and the Bihar Prohibition and Excise Act.
- Whether ownership of the vehicle, without conscious possession of the contraband, suffices to sustain the charges.
- Whether the procedural requirements of Section 100 CrPC/Section 103 of the Bhartiya Nagarik Suraksha Sanhita were complied with in the seizure.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of anticipatory bail.
