Holding

The Court granted bail to the petitioner, subject to a bond and the condition of not committing similar offences.

Summary

The petitioner, Gautam Kumar Jha, sought bail in a case (PS Case No. 41 of 2026) alleging possession of 342.96 litres of illicit foreign liquor, violating Sections 274, 275, 3(5) of the Bihar Narcotic Substances (BN.S.) Act, 2023 and Section 30(a) of the Bihar Prohibition & Excise Act. The petitioner claimed he was merely the driver, unaware of the contraband, and argued that the seizure violated Section 105 of the BN.S. Act. The State opposed bail, citing the petitioner’s alleged involvement in four similar prior cases. After hearing both sides, the Court considered the petitioner’s claim of innocence, the procedural lapse in seizure, and his custodial status since 15‑03‑2026. The Court granted bail on a bond of Rs.10,000 with two sureties, imposing a condition that he not engage in similar offences in the future.

Issues considered

  • Whether bail should be granted to the petitioner despite alleged involvement in illicit liquor offences
  • Whether the seizure of the liquor complied with Section 105 of the BN.S. Act
