Bail was granted to the petitioner subject to a bond and specified conditions.
Summary
The petitioner, Deepak Yadav, was arrested on 28 January 2026 in connection with a case involving the alleged illegal possession of 909 litres of Nepali-made liquor. He was charged under Section 30(a) of the Bihar Prohibition and Excise Act and Sections 274, 275 read with Section 3(5) of the B.N.S. The petitioner contended that he had no direct possession of the liquor and that the case was based solely on the confession of an apprehended co‑accused, Shambu Ram, alleging non‑compliance with procedural requirements under Section 100 of the Cr.P.C. and Section 103 of the B.N.S. The prosecution highlighted four prior criminal antecedents, two of which were on bail and two pending trial. The court, after considering the lack of direct evidence against the petitioner and his claims of innocence, granted bail on a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation, appearance, non‑tampering with evidence, and verification of criminal antecedents. The bail order was directed to be implemented by the Exclusive Special Judge (Excise) in Jhanjharpur, Madhubani.
Issues considered
- Whether bail should be granted to the petitioner despite the seriousness of the offences under the Bihar Prohibition and Excise Act and the B.N.S.
- Whether the confession of a co‑accused, without direct possession evidence, suffices to deny bail.
- Whether the petitioner’s prior criminal antecedents justify denial of bail.
