Patna High Court

Vikash Kumar @ Jila Rai @ Vikash Kumar Jila RayversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that bail could not be granted due to the gravity of the offences.

Summary

Vikash Kumar was arrested in connection with a case involving murder and several other offences under the Indian Penal Code and the Arms Act. He applied for regular bail, claiming false implication, lack of prior criminal record, and willingness to cooperate with the trial. The State opposed the bail, asserting that the petitioner was one of the assailants. The court examined the seriousness of the charges, including murder, and concluded that the gravity of the offences outweighed the petitioner's arguments. Consequently, the bail application was dismissed.

Issues considered

  • Whether bail should be granted to an accused of murder and other serious offences under the IPC and Arms Act
