Decided

BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to a Rs.30,000 bail bond and verification of his criminal antecedent.

Summary

The petitioner, Ratan Kumar, was apprehended for alleged possession of 10 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The prosecution claimed recovery of the liquor and cash, while the petitioner asserted innocence, no possession, and a clean criminal record. The State opposed bail, but the court considered the petition for anticipatory bail under Section 2(1)(d) of the Bihar Non‑Syndicated Substances Act, 2023 and the inherent powers of the court under Section 482(2) of the CrPC. The court granted anticipatory bail, directing the petitioner to furnish a bail bond of Rs.30,000 and imposing verification of his criminal antecedent by the trial court. The order also provided for cancellation of bail if the petitioner concealed any prior convictions.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the Bihar Prohibition and Excise (Amendment) Act, 2022 and the Bihar Non‑Syndicated Substances Act, 2023.
  • Whether the conditions imposed under Section 2(1)(d) of BNSS, 2023 and Section 482(2) CrPC are sufficient to grant anticipatory bail.
