Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Rajesh Sahni, sought regular bail in a case under Section 30(a) of the Bihar Prohibition and Excise Amendment Act after 169.75 litres of illicit foreign liquor was seized from a vehicle. He contended that he was falsely implicated, that the vehicle was driven by another individual, Siddhant Kumar, and that no liquor was recovered from his possession. He also argued that the police failed to comply with Section 105 of the B.N.S.S. during the seizure and pointed to the bail granted to the co‑accused in a related case. The State opposed bail, highlighting the petitioner’s seven prior similar offences. After hearing both sides, the court granted regular bail on a bond of Rs.10,000 with two sureties and imposed conditions restricting future involvement in similar offences.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.
  • Whether the alleged non‑compliance with Section 105 of the B.N.S.S. during seizure warrants bail.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
