Patna High Court

Santosh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the petitioner's application for regular bail.

Summary

Santosh Kumar was arrested in August 2024 in connection with an alleged assault under Sections 126(2), 115(2), 118(1), 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The petitioner claimed that the incident was a minor village dispute, that no serious injury occurred, and that he was also assaulted by the complainant. The State opposed bail, arguing the seriousness of the offences. After considering the nature of the allegations, the length of custody, and the material on record, the court found no compelling reason to keep the petitioner detained. Consequently, the court granted regular bail on a bond of Rs.10,000 with two sureties and imposed conditions of periodic police‑station attendance and regular trial participation. The order was made on a prima facie basis and does not prejudice the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under Sections 126(2), 115(2), 118(1), 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
  • Whether the circumstances of the alleged assault and the period of custody justify denial of bail.
