Patna High Court

Tarzan YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to specified surety, monetary deposit, and attendance conditions.

Summary

The petitioner, Tarzan Yadav, was arrested in connection with the recovery of 378 litres of illicit liquor under Section 30(a) of the Bihari Prohibition and Excise Amendment Act. He applied for bail, claiming innocence, a clean antecedent, and offering to donate Rs. 25,000 to a charitable organization. The State opposed the bail. The High Court, after considering the submissions, ordered the release of the petitioner on bail upon furnishing a Rs.10,000 bond with two sureties of the same amount, a deposit of Rs.25,000 to the Ramakrishna Mission Vidyapith, and regular attendance at the police station. The Court also directed verification of the petitioner’s antecedent before accepting the bail bonds and clarified that the order is limited to the bail application and does not prejudice the trial.

Issues considered

  • Whether bail should be granted to the accused in a case of alleged illicit liquor possession under Section 30(a) of the Bihari Prohibition and Excise Amendment Act.
  • Whether the petitioner’s claim of a clean antecedent and willingness to make a charitable donation justify bail.
  • What conditions, if any, should be imposed on the grant of bail in such offences.
