Holding

The application for regular bail is dismissed, and the earlier order denying bail is upheld.

Summary

The petitioner, Sokil Sahni, applied for regular bail in a dacoity case under Section 310(2) of the Bharatiya Nyaya Sanhita, 2023, after an earlier bail application was rejected. The prosecution alleged that the petitioner participated in a dacoity at the informant's house and noted that he is already accused in four other cases and has been in custody since 27 May 2025. The petitioner’s counsel argued that his name appeared only in a co‑accused’s confessional statement. The High Court examined whether there were sufficient grounds to revisit its earlier order denying bail. Finding no merit in the petitioner's contentions and considering the seriousness of the offence and the pending cases, the Court upheld its prior decision and dismissed the bail application.

Issues considered

  • Whether regular bail can be granted to an accused of dacoity under Section 310(2) of the Bharatiya Nyaya Sanhita, 2023 given the seriousness of the offence and the existence of multiple pending cases.
  • Whether the earlier order denying bail can be reviewed in light of the petitioner's claim that his name appears only in a co‑accused’s confessional statement.
