Patna High Court

Chhotu KumarversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to a bond and verification of his criminal antecedent.

Summary

The petitioner, Chhotu Kumar, feared arrest in an excise case (Case No. 1082 of 2025) involving 720 litres of illicit liquor, alleged under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The prosecution linked the petitioner to the contraband through his ownership of a vehicle allegedly used by a co‑accused, Vikash Kumar. The petitioner contended he had no possession of the liquor, had a clean antecedent, and had merely lent the vehicle for unrelated purposes. The State opposed bail. The Court, applying Section 2(1)(d) of the BNSS, 2023 and the conditions of Section 482(2) of the same Act, granted anticipatory bail for four weeks, subject to a Rs 30,000 bond and verification of the petitioner’s criminal antecedent, with provision for cancellation if concealment is discovered.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 2(1)(d) of the BNSS, 2023 in view of the alleged involvement in an excise offence.
  • Whether the petitioner’s ownership of the vehicle used by a co‑accused suffices to justify denial of bail.
