The court granted anticipatory bail to the petitioner subject to conditions under Section 482(2) of BNSS 2023.
Summary
The petitioner, Ram Ekbal Rai, sought anticipatory bail fearing arrest in a complaint case punishable under Section 108 of the BNS. He is the step father‑in‑law of the informant and alleges that the deceased husband’s suicide resulted from a family land dispute and not from any wrongdoing on his part. The State opposed the bail, arguing that the allegations against the petitioner were sufficient to justify detention. The court noted the petitioner’s clean antecedents, lack of involvement in the family dispute, and the general nature of the accusations. Relying on Section 482(2) of the BNSS 2023, the court granted anticipatory bail on the condition of a Rs.10,000 bail bond and two sureties, to be filed within eight weeks of arrest. The order was made by Justice Prabhat Kumar Singh.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 482(2) of BNSS 2023.
- Whether the allegations of involvement in the suicide and land dispute constitute sufficient ground to deny bail.
- Whether the petitioner’s clean antecedent and lack of direct involvement merit the grant of bail.
