BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Manoj Singh, sought regular bail in a case registered under Sections 190, 191(2), 115(2), 126(2), 109(1), 352 and 351(2) of the B.N.S., alleging assault. He claimed innocence, asserting that he was falsely implicated due to a land dispute and highlighted his advanced age of about 70 years and twelve prior criminal antecedents. The prosecution, represented by the Additional Public Prosecutor and the informant’s counsel, opposed the bail. The court considered the petitioner’s age, period of custody since 3 December 2025, and the nature of the allegations, and decided to grant regular bail. Accordingly, the petitioner was ordered to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties of the same amount.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the seriousness of the offences and his criminal antecedents.
