The Court granted regular bail to the petitioner with specified conditions.
Summary
The petitioner, Jaypal Kumar, was arrested in connection with the seizure of 620 litres of illicit liquor from a pick‑up van, alleged to violate Section 317(5) of the B.N.S. and Section 30(a) of the Bihar Prohibition & Excise Act, 2022. He applied for regular bail, claiming innocence, a clean criminal record, and offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the bail. The Court, after considering the facts and the petitioner's lack of antecedents, allowed the bail application subject to a bond of Rs. 10,000 with two sureties, verification of his clean record, a Rs. 25,000 donation to Ramakrishna Mission Ashrama, and a requirement to appear at the police station on two Sundays each month. Non‑compliance would lead to cancellation of bail. The order was pronounced by Justice Sandeep Kumar.
Issues considered
- Whether regular bail should be granted to the accused in offences under Section 317(5) of the B.N.S. and Section 30(a) of the Bihar Prohibition & Excise Act, 2022, considering the nature of the offence and the accused's antecedents.
