Patna High Court

Ranjan KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The application for anticipatory bail was allowed.

Summary

The petitioner, Ranjan Kumar, feared arrest in a case (Barun P.S. Case No. 58 of 2026) involving the alleged recovery of 84 litres of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act. He applied for anticipatory bail, offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the prayer. The High Court, after considering the facts and the petitioner's submission, allowed the anticipatory bail application, directing the petitioner to furnish bail bonds of Rs. 10,000 with two sureties, deposit the Rs. 25,000 donation in Ramakrishna Math, and attend the Barun Police Station every Sunday. The court clarified that its observations were prima facie and not to influence the trial. Consequently, the petitioner was released on anticipatory bail subject to the stipulated conditions.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner in the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the condition of a charitable donation can be imposed as a term of anticipatory bail.
