Hiralal Kumar Rajbhar @ Hiralal RajbharversusThe State of Bihar

Holding

The Court granted bail to the petitioner on condition of a Rs. 10,000 bond with two sureties.

Summary

Hiralal Kumar Rajbhar was arrested in connection with a case registered under multiple sections of the Bihar Narcotic Substances (BNSS) Act, 2023 and the Arms Act. The prosecution alleged that a silver knife and a bike were recovered from his possession. The petitioner claimed innocence, arguing that the seizure was not conducted in accordance with Section 105 of the BNSS Act and that nothing was actually recovered from him. He also highlighted that he had been in judicial custody since 25 October 2025 and that the State’s opposition was based on three prior criminal cases. After hearing both sides, the High Court found merit in the petitioner's arguments and ordered his release on bail upon furnishing a bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious charges under the BNSS Act and Arms Act
  • Whether the seizure of alleged articles complied with Section 105 of the BNSS Act
  • Whether the petitioner’s prior criminal antecedents justify denial of bail
