Bail was granted to the petitioner on the condition of a Rs.10,000 bond with two sureties.

Summary

The petitioner, Brijnandan Rai, was arrested in connection with the seizure of 509.76 litres of illicit foreign liquor, alleged under Sections 30(a), 32 and 41(1) of the Bihar Prohibition & Excise Act. He contended that no liquor was found in his possession and that his name was merely disclosed by the apprehended individuals, asserting no prior criminal record. The State opposed bail, citing the seriousness of the offence. After hearing both sides, the Court considered the lack of direct possession and the petitioner’s clean record, and decided to grant bail. He was ordered to furnish a bail bond of Rs.10,000 with two sureties of the same amount, subject to the satisfaction of the Exclusive Special Excise Court.

Issues considered
