Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, Harinarayan Kumar, a truck driver, was arrested in connection with the seizure of 345.6 liters of illicit foreign liquor from his vehicle, alleged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act. He claimed innocence, stating he was unaware of the liquor and that the police failed to follow Section 105 of the BNSS during the seizure. The petitioner had no prior criminal record and had been in judicial custody since 18 February 2026. The State opposed his regular bail application. After hearing both sides, the High Court found merit in the petitioner's arguments and ordered his release on regular bail, subject to a bond of Rs.10,000 and two sureties of the same amount.

Issues considered

  • Whether the petitioner is entitled to regular bail under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
  • Whether the seizure complied with the procedural requirements of Section 105 of the BNSS.
  • Whether the petitioner’s lack of criminal antecedent and claim of false implication warrant grant of bail.
