Patna High Court

Ranjit RaiversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners, subject to specified bond and surety conditions.

Summary

The petitioners, Ranjit Rai, Uday Rai and Awdesh Ray, sought anticipatory bail after an FIR alleged that 420 litres of illicit country-made liquor were recovered from sacks on a riverbank, implicating them under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018. The petitioners argued that no independent witness linked them to the liquor, that the seizure was from an open, publicly accessible area, and that nothing was found in their personal possession, emphasizing their clean criminal record. The State opposed the bail on the basis of the FIR allegations. The Court, after considering the facts, granted anticipatory bail subject to a bail bond of Rs.10,000 with two sureties each, to be filed within four weeks, and conditioned the order on Sections 438(2) of the Cr.P.C. and 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order aims to protect the petitioners from arrest while the investigation proceeds.

Issues considered

  • What is the appropriateness of granting anticipatory bail under Section 438 Cr.P.C. to the petitioners accused under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018?
  • Does the lack of independent witness testimony and absence of seizure from the petitioners' possession justify anticipatory bail?
