Raju Nat @ Raju NutversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Regular bail was denied because prima facie material indicated the petitioner’s involvement in a serious offence and he had multiple prior convictions.

Summary

The petitioner, Raju Nat, was charged under Sections 108(1), 109, 61(2), 111 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 for allegedly shooting the deceased, with the informant identifying him as one of the shooters. He has been in custody since 16 July 2025 and possesses six prior criminal convictions. The court examined the seriousness of the alleged offence, the existence of prima facie evidence linking the petitioner to the crime, and his criminal antecedents. Considering these factors, the court found that the conditions for granting regular bail were not met. Consequently, the application for regular bail was rejected, with the court emphasizing that its observations were limited to the bail application and would not affect the trial.

Issues considered

  • Whether regular bail can be granted to the petitioner under the Bharatiya Nyaya Sanhita, 2023 given the seriousness of the offence, prima facie evidence of involvement, and the petitioner’s multiple prior convictions?
