Patna High Court

Shashi Kumar Mishra @ Shashi Bhushan Mishra @ Shashi MishraversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the bail application, granting bail subject to conditions.

Summary

The petitioner, Shashi Kumar Mishra, was arrested in May 2025 in connection with a Paharpur police case alleging offences under Sections 126(2), 115(2), 118(1), 118(2), 109(1) and 303(2) of the Indian Penal Code, including stabbing the victim. He claimed a clean antecedent and asserted innocence, seeking bail. The High Court considered the seriousness of the allegations, the period of custody, and the petitioner’s claim of no prior record. It directed that bail be granted on a bond of Rs 10,000 with two sureties, subject to monthly police‑station attendance and verification of antecedent. The order was limited to the bail application and did not prejudice the trial’s merits.

Issues considered

  • Whether bail can be granted in a case involving serious offences such as attempted murder and other IPC offences.
  • Whether the petitioner’s claim of a clean antecedent and the length of custody justify bail.
