Patna High Court

Malti DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court ordered the release of the petitioner on bail with specified conditions.

Summary

The petitioner, Malti Devi, was arrested on 15 October 2025 in connection with a case of alleged abetment of suicide under Sections 306 and 34 of the Indian Penal Code. The prosecution alleges that an altercation between the informant's daughter and the petitioner led to false accusations, which purportedly caused the daughter to commit suicide. The petitioner contended that the FIR is fabricated, that there is no specific allegation of an overt act against her, and that she has a clean criminal record. The State opposed bail, arguing the seriousness of the charges. The Court examined the nature of the allegations and the lack of concrete evidence linking the petitioner to the suicide. Consequently, the Court granted bail on a bond of Rs.10,000 with two sureties and imposed conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents.

Issues considered

  • What is the appropriateness of granting bail in a case of alleged abetment of suicide under Sections 306 and 34 IPC?
  • Does the FIR contain sufficient specific allegations to justify continued detention?
  • Whether the petitioner poses a risk of tampering with evidence or fleeing the trial.

                                3. The prosecution case, in brief, as contained in

submits that the petitioner has clean antecedent. The allegation

as alleged in the FIR is false and fabricated and the petitioner

petitioner rather there is general and omnibus allegation against

all the accused persons including the petitioner and the deceased

above named, be released on bail on furnishing bail bond of

Rs.10,000/- (Ten Thousand) with two sureties of the like amount
