Patna High Court

Devi Lal Sahani @ Debulal SahaniversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petitioner's application for regular bail.

Summary

The petitioner, Devi Lal Sahani, was arrested in connection with a murder case (Paroo P.S. Case No. 588 of 2025) alleged under Section 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The prosecution claims that thirteen persons surrounded the deceased and three of them fired shots, implicating the petitioner. The petitioner contended that he is innocent, has no criminal antecedent, and that the allegations against him are vague and omnibus. The State opposed the bail application. Considering the petitioner’s clean antecedent, lack of specific incriminating material, and the circumstances, the Court allowed regular bail on a bond of Rs. 10,000 with two sureties and imposed conditions of regular police station attendance and trial cooperation. The order is limited to the bail application and does not prejudice the merits of the trial.

Issues considered

  • Whether regular bail should be granted to the petitioner under the charges of murder and illegal possession of arms.
  • Whether the petitioner’s clean antecedent and the absence of specific allegations justify the grant of bail.
