Holding

The court held that regular bail could not be granted to the petitioner.

Summary

The petitioner, Rupesh Kumar, applied for regular bail in a case registered under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023, relating to an armed robbery in which Rs. 15,60,540 was looted at gunpoint. The prosecution alleged that the petitioner was one of the perpetrators and was driving the motorcycle used in the crime. A co‑accused’s self‑inculpatory statement identified the petitioner, although the looted money and a mobile phone were later recovered at the petitioner’s instance. The petitioner has been in custody since 6 December 2025 and possesses a prior criminal antecedent. Considering the seriousness of the offence, the involvement of the petitioner, and his antecedent, the court declined to grant regular bail.
