The petitioner is entitled to regular bail and the application is allowed.
Summary
Jayram Mandal was arrested in connection with a kidnapping case (PS Ladaniya Case No. 375 of 2024) alleged under Sections 137(2), 96 and 3(5) of the Indian Penal Code. The prosecution claimed he lured a girl and kidnapped her, while the petitioner asserted his innocence and highlighted his clean record. The victim’s statement recorded under Section 183 of the CrPC indicated that she had eloped with the petitioner and subsequently married him. The court examined these facts and concluded that the circumstances did not warrant continued detention. Consequently, the court granted regular bail, requiring a bond of Rs. 10,000 with two sureties of the same amount. The order was limited to bail and did not prejudice the merits of the trial.
Issues considered
- Whether the petitioner is entitled to regular bail in a kidnapping case under Sections 137(2), 96 and 3(5) of the IPC.
- Whether the victim’s statement of elopement and marriage affects the bail consideration.
