DISMISSED

Holding

The Court held that regular bail could not be granted to the petitioner.

Summary

The petitioner, Kanhaiya Kumar, was arrested in connection with a case of assault and stabbing of an informant under Sections 126(2), 115(2), 118(1), 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. He has been in custody since 14 January 2026 and has no prior criminal record. The prosecution presented prima facie material indicating his participation in the stabbing, and the injured informant specifically identified him as an assailant. The High Court examined the seriousness and gravity of the offences and the existence of prima facie evidence. Concluding that the allegations were grave, the Court declined to grant regular bail and dismissed the bail application, noting that its observations were limited to the bail matter and would not affect the trial.
