Given the specific and direct accusations, the gravity of the offences and the petitioner’s criminal antecedent, the court rejected the prayer for anticipatory bail.
Summary
The petitioner sought anticipatory bail fearing arrest in a case alleging assault with a pistol, forced signing of blank papers and multiple offences under the B.N.S. and the Arms Act. The prosecution alleged that on 10 February 2026 the petitioner, along with others, assaulted an informant at Kosi bridge and later at Kamat, coercing signatures on blank documents. The petitioner pleaded innocence, claiming false implication and an ulterior motive. The State opposed bail, highlighting the petitioner’s inclusion in the FIR, the specific and grave nature of the accusations, and his prior criminal antecedent. Considering the seriousness of the charges, the direct accusations and the petitioner’s criminal record, the court rejected the anticipatory bail application.
Issues considered
- Whether anticipatory bail should be granted to the petitioner given the specific accusations and seriousness of the offences.
- Whether the petitioner’s prior criminal antecedent justifies denial of anticipatory bail.
