Holding

Bail was denied to the petitioner.

Summary

The petitioner, Sanjay Pandey, applied for bail in a case registered in 2006 under Sections 498(A), 304(B), 34 of the Indian Penal Code, the Bharatiya Nyaya Sanhita, 2023, and Sections 3 and 4 of the Dowry Prohibition Act. The allegations involve the murder of the informant's sister, with the police final report submitted in 2014. The High Court noted that the petitioner was evading court processes and therefore was not inclined to grant bail. Consequently, the bail application was rejected, with a direction that the petitioner may re‑apply after six months if the trial remains pending. The Court clarified that its observations were limited to the bail application and should not affect the merits of the trial.
