BAIL GRANTED

Holding

The court granted bail to the petitioner with specified conditions.

Summary

Amit Kumar was arrested on 25 February 2026 in connection with an excise case involving the seizure of 466.560 litres of illicit liquor from a pickup van. He pleaded not to be the owner or driver of the vehicle and asserted a clean criminal record, claiming false implication. The prosecution opposed bail, citing offences under Sections 30(a), 32(3) and 41(i)(ii) of the Bihar Prohibition and Excise Act and alleged non‑compliance with Sections 103 and 105 of the BNSS, 2023. The court examined the facts, the petitioner’s claim of no conscious possession, and the statutory bail criteria. It granted bail on a Rs.10,000 bond with two sureties, subject to conditions of cooperation, presence in court, non‑tampering with evidence, and verification of antecedents. The order directed that bail should not be delayed for antecedent verification.

Issues considered

  • Whether the petitioner is entitled to bail despite alleged offences under the Bihar Prohibition and Excise Act.
  • Whether the seizure and investigation complied with Sections 103 and 105 of the BNSS, 2023, affecting bail considerations.
