Holding

The Court allowed the petitioners' application for anticipatory bail.

Summary

Petitioners Pahadi Bind and Ajay Bind sought anticipatory bail fearing arrest in Laxmipur Police Station Case No. 275 of 2025, which alleged their participation in an unlawful assembly that assaulted an informant and her son. The prosecution alleged offences under multiple sections of the Bhartiya Nyaya Sanhita, while the petitioners contended they were falsely implicated and had no allegation of assault against them, noting they were already on bail in other cases. The Additional Public Prosecutor opposed the bail. The Court examined the record and, applying Section 482(2) of the Bhartiya Nyaya Sanhita, ordered that the petitioners be granted anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions. The application for anticipatory bail was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bhartiya Nyaya Sanhita in the present case.
  • Whether the allegations against the petitioners constitute sufficient ground for their arrest.
